The evidence laid out in this 5-part series paints a devastating and undeniable picture of Rockland County Acting Supreme Court Justice David Fried. From his troubling political origins to his unhinged courtroom demeanor, David Fried has shown a consistent pattern of behavior that is entirely incompatible with the ethical standards required of a New York State judge.
Let us review the facts.
David Fried’s political rise was tainted by associations with convicted slumlords offering campaign favors, and he has touted connections to associates of Jeffrey Epstein. Once on the bench, his temperament deteriorated to the point where he spent judicial resources berating a minority female attorney for attempting to put her client's emergency circumstances on the record.
When his appalling behavior in that January 28, 2026 inquest triggered a bar complaint, David Fried did not recuse himself or correct his conduct. Instead, he retaliated. He authored a March 30, 2026 decision that served less as a legal judgment and more as a personal manifesto designed to defame the reporting attorney.
To ensure his retaliation stuck, David Fried weaponized the law. Knowing he had failed to issue a required Order to Show Cause (OSC) to properly sanction the attorney—which would have afforded her due process and exposed his own malfeasance to an appellate court—he exploited a loophole. He ordered her to pay $3,500 under the guise of "joint and several costs," explicitly stating it was "not a sanction" to bypass the legal requirements he failed to meet.
This is the behavior of a judicial tyrant. It is textbook retaliation, and it is a blatant violation of the Rules Governing Judicial Conduct, which mandate that judges must act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.
David Fried is not promoting public confidence. He is tearing it down.
The New York State Commission on Judicial Conduct (CJC) has a mandate to investigate and discipline judges who abuse their power. The bar complaint filed against David Fried is not a mere grievance over a lost motion; it is a documented alarm bell about a jurist who uses his gavel to settle personal vendettas.
The CJC must immediately launch a comprehensive investigation into David Fried’s conduct in Adler v. Pollak, his retaliatory use of "costs" to evade due process, and his history of courtroom bullying. Furthermore, Governor Kathy Hochul, who appointed David Fried to the Court of Claims in 2023, must answer for the vetting process that allowed a man with such a deeply flawed ethical compass to ascend to a statewide judicial role.
David Fried has proven he cannot separate his ego from his rulings. Until the Commission acts, every attorney walking into his Rockland County courtroom is at risk of facing a judge who writes his own rules.
